Terms of Service

Eligibility

You represent that you are at least 18 years old and can enter this agreement. You may create or manage information about a child only when you are authorized to do so. Harbor+ does not offer accounts to children in the initial release.

Educational information — not medical care or emergency support

Harbor+ provides general educational information, family-coordination tools, and user-controlled recordkeeping. It does not provide medical advice, diagnosis, treatment, patient monitoring, or emergency services. Use of Harbor+ does not create a clinician-patient or other professional relationship with TerraKode, its staff, contributors, or technology providers.

Do not delay seeking professional care because of the Service. If you believe you or a child may have an emergency, call 911 or your local emergency number, or contact an appropriate licensed professional immediately. Harbor+ does not guarantee that any notification, message, timer, or alert will be sent, delivered, seen, acted upon, or available during an emergency.

Content may summarize or link to sources and may present clearly attributed perspectives. It is not tailored professional advice. You are responsible for using your judgment and consulting qualified professionals for your circumstances.

Accounts, Family Spaces, and access

Keep account credentials and devices secure. Promptly notify us at [email protected] if you believe your account has been compromised. You are responsible for the people you invite and permissions you grant, subject to the Service's privacy controls.

Family Space membership, relationship labels, and display labels do not prove legal parentage, custody, guardianship, medical-consent authority, or any other legal status. TerraKode does not verify or adjudicate family relationships.

We may suspend, remove, or restrict access where reasonably necessary to protect the Service, users, TerraKode, or others, or when these Terms are violated. We will use reasonable notice where appropriate and legally allowed.

Your content and permissions

You retain ownership of content you submit to Harbor+ ("User Content"). You grant TerraKode a limited, non-exclusive, worldwide license to host, process, back up, transmit, display to people you authorize, and otherwise use User Content only as necessary to operate, secure, support, and improve the Service as described in the Privacy Notice.

You represent that you have the rights and permissions needed to submit User Content and share it with selected members. Do not upload unlawful, infringing, harmful, or malicious material. Do not use Harbor+ to impersonate others, invade privacy, bypass access controls, or interfere with the Service.

Third parties and future AI features

TerraKode may provide content from third parties or links to third-party services. We do not control third-party services or guarantee their accuracy, availability, or suitability. A reference does not mean TerraKode endorses it.

If Harbor+ offers a generative-AI feature, its output is informational, may be incomplete or incorrect, and must not be treated as medical, professional, legal, or emergency advice. That feature is subject to the separate safety, content, and privacy controls disclosed in the Service.

Intellectual property and feedback

The Service, including its software, designs, trademarks, and content owned by TerraKode, is protected by law. Subject to these Terms, TerraKode grants you a limited, personal, revocable, non-transferable right to use the Service for its intended purpose. No other rights are granted.

If you voluntarily provide feedback, you grant TerraKode the right to use it without restriction or compensation, provided TerraKode does not identify you without permission.

Availability and changes

The Service, particularly beta or offline features, may change, be unavailable, or contain errors. We may modify, suspend, or discontinue features with reasonable notice when practical. Export and deletion behavior is described in the Privacy Notice.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TERRAKODE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE AVAILABILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME LIMITATIONS MAY NOT APPLY TO YOU.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRAKODE AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRAKODE'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TERRAKODE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.

Indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless TerraKode and its members, managers, employees, contractors, licensors, and service providers from claims, damages, liabilities, and expenses arising from your unlawful use of the Service, violation of these Terms, or User Content for which you lacked the necessary rights or consent.

Changes, termination, and contact

We may update these Terms. For material changes, we will provide notice and seek acceptance when legally required. Your continued use after the effective date of an updated version means you accept it, to the extent permitted by law.

You may stop using the Service at any time. Account deletion, export, and data retention are described in the Privacy Notice. Sections that by their nature should survive termination will survive.
